Booking Terms and Conditions for Teänia Cottage, Crow’s Nest
& Cabin by the Beach for 2024
In these booking terms and conditions, ‘you’ and ‘your’ means the person named on the letting agreement and all members of your party which are named on the letting agreement. ‘We’, ‘us’ and ‘our’ means Dawn K Bradford and Keith R Bradford t/a S.M.I.L.E. & S.M.I.R. aka St Martin’s Self Catering, Lower Town, St Martin’s, Isles of Scilly, TR25 0QW.

CONTRACT
The Contract for a short-term holiday rental will be between the Owners of Teänia Cottage, Crow’s Nest and Cabins by the Beach (referred to as “us” or “we”) and the person making the booking and all members of the holiday party (referred to as “you” or “your”) under the following booking conditions. UK law will govern the Contract. The contract is not effective until we have received and processed the booking fee. The contract will be subject to these non-refundable booking conditions and must be complied with. The party leader must be at least 18 years of age at the time of booking and the letting agreement must list names, addresses and ages of your party.

CONDITION OF BOOKING
Bookings are only accepted on the clear understanding that booking fees are non-refundable, and that holiday insurance is sought in order to cover yourselves and us from loss of funds due to cancellation beyond control of either party and “Force Majeure”.
When you make a booking (with the required payment) and it has been confirmed by us, you will have entered directly into a contract which binds you, all members of your party and us in various ways. These booking conditions are deemed to have been accepted by you and will continue until the last member of your party has departed from the accommodation and its grounds.
BOOKING REQUIREMENTS

Booking leader:
The person who placed the booking shall be responsible for the party staying and must ensure all members are aware of and accept this contract.

By making a booking, you confirm you:

Are over the age of 18

Are responsible for supplying an accurate total number of all members in the party.

Will not bring any pets or animal due to our strict ‘no pets’ policy to enable us to cater for guests that may have allergies.

Are responsible for making all payments due to us by the appropriate dates outlined in the Letting Agreement.

Will not exceed the total party number as stated on the ‘letting agreement’ and if this happens, we reserve the right to immediately terminate your stay and/or claim additional costs as we see fit.

By making a booking, we understand:

You take out your own personal travel/holiday insurance suitable for your needs; we also advise that the insurance policy should cover you for all forms of travel delay, including adverse weather conditions in the UK and “Force Majeure”.

We have the right to obtain the name, age, and address of each member of the booking party before confirming your booking.

Do not allow “stag/hen” or similar types of groups, in order to preserve our peaceful environment.
PAYMENT
Bookings are confirmed on receipt of the completed and signed letting agreement and receiving the non-refundable booking fee of one third (â…“) of the total accommodation cost within 72 hours of receiving the letting agreement. The balance of the rental cost will be due for payment twelve (12) weeks before the arrival date of your booking. We reserve the right to cancel a booking where payment has not been received twelve weeks (12) before the arrival date. If the booking is made within twelve (12) weeks of the holiday start date, then payment will be due in full. Once you have a confirmed booking (i.e. the booking fee has been paid and processed), you are responsible for paying the balance payment at the required time as reminders are not sent out.
CANCELLATION
Cancellations must be immediately notified to us and confirmed in writing.

In the event of cancellation with less than twelve (12) weeks notice, the full cost of your holiday is non-refundable unless we are able to let or part let the cancelled period, in which case a proportional refund will be made at the end of said cancelled period. Cancellation with more than 12 weeks' notice will only incur loss of the non-refundable booking fee.
CIRCUMSTANCES ON SITE BEYOND THE CONTROL OF THE OWNER
If for any reason we must cancel your booking in advance due to circumstances beyond our control at our site – for example fire, flood, or destruction/damage to the property – then we will at our sole discretion seek to find you comparable accommodation for your dates, or will offer you alternative dates, a full value voucher, or we will refund the full amount of the booking. If we must terminate your holiday early for the above reasons you will be relocated/credited/refunded part of the booking fee value based on the time remaining of the booking. This will be the full extent of our liability. No additional compensation, expenses or costs will be payable.
FORCE MAJEURE
We do NOT cover you for your holiday being unavailable due to natural disasters, terror attacks, acts of war, hijacking, riots, incidents of civil unrest, pandemics, epidemics, or general restrictions on movement imposed by local or national Government, which may prevent you from taking your holiday. A condition of booking is that guests take out a holiday insurance policy which covers booking cancellations. If you do not take out adequate insurance, you then accept responsibility for any loss of funds that you may incur due to cancellation.

TERMS OF USE
You may access Teania and a Cabin by the Beach from 14.00, and Crow's Nest from 13:00 on the day of arrival (for earlier arrivals luggage can be stored). Please note that departure is by 09.00 on your final day (later departures are not possible however luggage can be stored).
Keys to the property will be left in the door for your arrival and we ask that you leave them in the same place on your departure.
You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period.
The agreement to stay in the property for the holiday period does not create the relationship of Landlord and Tenant between the parties.
You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.
On departure, you are requested to leave the accommodation in a clean and tidy condition. Departure instructions are listed in the property which include removing bedlinen and placing in the bin liner supplied, putting all towels, robes, tea towels clean or dirty in the bin liner supplied, stacking the dishwasher and turning on an appropriate setting, placing all rubbish in the outside bins, empty all fridge/freezers and cupboards of food stuffs.
NUMBER OF PERSONS USING THE PROPERTY
Under no circumstances may more than the maximum number of persons stated on the letting agreement occupy the property, unless by prior arrangement with the owners. We reserve the right to refuse admittance if this condition is not observed.

LIABILITY
We shall not be liable to you or your party for loss or damage to your belongings howsoever arising. You must take all necessary steps to safeguard yourselves and your belongings.

CARE OF THE PROPERTY
You are responsible for our property and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in or on the property. You must leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. You must not use the properties for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties. Smoking is not allowed in any of the properties.

DAMAGES & BREAKAGES
You are legally bound to reimburse us for replacement, repair, or extra cleaning costs on demand (although we would not charge you for the odd glass or plate).
RIGHT OF ENTRY
We shall be allowed reasonable right of entry to the property at all reasonable times for the purpose of inspection or to carry out any necessary repairs or maintenance.

COMPLAINTS
Every effort is made to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, it is essential that you contact us immediately to give us the chance to resolve it. We value your custom and want you to return. We are on site and will do our best to resolve any problem. This is easier to do before your leave!

PETS AND SMOKING
Pets are not permitted however allowances will be made for assistance dogs by prior arrangement. Smoking is strictly forbidden however no restriction is made in the outside area of the accommodation.

PRIVACY
All information we collect and hold about you and members of your party will be used in accordance with our privacy policy which is available on our website.
